1. Acceptance of Terms
By downloading, installing, or using AquaMind ("the App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.
2. Description of Service
AquaMind is a water intake tracking application that helps users monitor their daily hydration. The App provides:
- Water intake logging and tracking
- Personalized hydration goals
- Smart reminders and notifications
- Social features (leaderboards, friend challenges)
- Gamification (collectible characters, XP, streaks)
- Health data integration via Apple HealthKit
- Special modes for pregnancy and breastfeeding
- Widget and CarPlay support
3. User Accounts
- You may use the App without an account for basic features.
- Social features require signing in with Apple.
- You are responsible for maintaining the security of your account.
- You must be at least 13 years old to use the App.
4. Subscriptions & In-App Purchases
4.1 AquaMind Pro
AquaMind offers a premium subscription ("AquaMind Pro") with the following plans:
- Monthly: Auto-renewable monthly subscription
- Yearly: Auto-renewable annual subscription
- Lifetime: One-time purchase for permanent access
4.2 Payment & Renewal
- Payments are processed through Apple's App Store.
- Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your Apple ID Account Settings.
4.3 Free Trial
If offered, the free trial period automatically converts to a paid subscription unless cancelled before the trial ends. Unused portions of free trials are forfeited upon purchasing a subscription.
4.4 Refunds
Refund requests must be directed to Apple, as all payments are processed through the App Store. We do not process refunds directly.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Harass, abuse, or harm other users through social features
- Attempt to manipulate leaderboards or challenge results
- Reverse engineer, decompile, or disassemble the App
- Use automated systems to access the App
- Impersonate another person or entity
- Share inappropriate or offensive content through social features
6. Health Disclaimer
AquaMind is not a medical device and does not provide medical advice.
- Hydration recommendations are general guidelines and may not be appropriate for everyone.
- The pregnancy and breastfeeding modes provide adjusted recommendations but should not replace advice from your healthcare provider.
- Always consult a healthcare professional for medical advice regarding hydration needs.
- The App's beverage recognition feature (photo analysis) is for convenience only and may not be accurate.
- We are not liable for any health decisions made based on the App's recommendations.
7. Intellectual Property
- All content, design, graphics, and code in AquaMind are owned by us and protected by intellectual property laws.
- The collectible characters, animations, and UI design are proprietary.
- You may not copy, modify, distribute, or create derivative works from the App.
8. Social Features
- Social features allow you to connect with friends via share codes.
- Your display name, avatar, progress, and streak data are visible to your friends.
- You can remove friends and leave challenges at any time.
- We reserve the right to moderate and remove content that violates these terms.
9. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided "as is" without warranties of any kind.
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability shall not exceed the amount you paid for the App in the last 12 months.
- We do not guarantee uninterrupted or error-free service.
10. Termination
- You may stop using the App at any time by uninstalling it.
- We may terminate or suspend your access if you violate these terms.
- Upon termination, your right to use the App ceases immediately.
- You can request deletion of your data by contacting us.
11. Changes to Terms
We reserve the right to modify these Terms of Use at any time. Material changes will be communicated through the App. Your continued use of the App after changes constitutes acceptance of the new terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
